RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS

8. RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS
Description

Reassignment of students to schools within the county have been approved by the administration or recommended by the Student Reassignment Appeal Board, in accordance with policies of the School Board.  They are presented for formal ratification.



Recommendation
That the reassignment of students to schools be ratified as presented.

GENERAL ITEMS

9. APPROVAL OF FINAL ORDER IN SCHOOL BOARD V. BERRY
Description
On January 27, 2010, Division of Administrative Hearings Administrative Law Judge Daniel M. Kilbride entered a Recommended Order recommending that the Board enter a final order "terminating the employment of Respondent from the date Respondent was placed on unpaid leave of absence."  The date Mr. Berry was placed on unpaid leave of absence is August 17, 2009.  Neither party has filed any exceptions to the recommended order.

Recommendation
That the School Board enter a Final Order adopting the Recommended Order of the Administrative Law Judge in DOAH Case Number 09-3557, terminating the employment of Brian Berry effective August 17, 2009."

AGREEMENTS/CONTRACTS

10. APPROVAL OF THE CONTRACT FOR PARENT EDUCATION SERVICES BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND MARGARET H. HUGHES
Description
Ms. Hughes will coordinate monthly workshops for ESE parents. These workshops will provide relevant information to current trends and encourage parent involvement. Ms. Hughes will also be the State Representative for the parent survey. Funding is via federal IDEA funds.

Recommendation
That the contract for parent education services between the School Board of Sarasota County and Margaret H. Hughes be approved as presented.

GRANTS

11. APPROVAL OF THE WE ARE FAMILY REACHING OUT GRANT PROPOSAL TO THE COMMUNITY FOUNDATION OF SARASOTA COUNTY FOR LAKEVIEW ELEMENTARY SCHOOL
Description
COMPETITIVE: Grant funds of $4,931 will allow expansion of Lakeview Elementary's We Are Family Project to include Oak Park Pro students in interviews, rehearsals and performances. 

Recommendation
That the School Board of Sarasota County approve the We Are Family Reaching Out grant proposal.

FIELD TRIPS

12. APPROVAL OF THE PINE VIEW SCHOOL JOURNALISM STUDENTS FIELD TRIP TO NEW YORK CITY, NEW YORK, ON MARCH 16, 2010 THROUGH MARCH 20, 2010
Description

Students attending the Columbia Scholastic Press Association (CSPA) Spring Conference in New York will be developing or honing skills that directly relate to the state standards for Journalism instruction (levels 1-4), marketing, writing, design, editing, photography, and media ethics.  The three day conference offers more than 350 sessions organized around strands related to newspaper, yearbook, magazine, online media, and broadcasts which will enable students to network on a national level within their own field, in addition to engaging in dialog with students involved in other areas of journalism that represent potential careers.  The course offerings are taught by high school and collegiate level experts in the field.



Recommendation
That the Pine View School Journalism students field trip to New York City, New York, on March 16, 2010 through March 20, 2010, be approved.

EXPULSIONS

13. APPROVAL OF EXPULSION CASE NO. 09-401
Description

The student listed in Expulsion Case No. 09-401, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On November 5, 2008, the student listed in Expulsion Case No. 09-401, violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 5, 2010.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-401, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until June 5 of the 2009-2010 academic year.

14. APPROVAL OF EXPULSION CASE NO. 10-094
Description

The student listed in Expulsion Case No. 10-094, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On October 14, 2009, the student listed in Expulsion Case No. 10-094, violated School Board Policy 5.34(1)(d), Fighting.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until October 29, 2010.



Recommendation

That in accordance with provisions of 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Case No. 10-094, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2009-2010 academic year, the 2010 summer session until October 29 of 2010-2011 academic year.

Description

The student listed in Expulsion Case No. 10-275, violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2011.

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 10-275, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2009-2010 academic year, the 2010 summer session, until June 4 of 2010-2011 academic year.

16. APPROVAL OF EXPULSION CASE NO. 09-451
Description

The student listed in Expulsion Case No. 09-451, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On May 22, 2009, the student listed in Expulsion Case No. 09-451, violated School Board Policy 5.32, Zero Tolerance (1)(e), Battery on School Board Employee.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until May 22, 2010.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case. No. 09-451, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until May 22 of the 2009-2010 academic year.

17. APPROVAL OF EXPULSION CASE NO. 10-201
Description

School Board Policy 5.34(4), permits the Board to hold in abeyance the expulsion of a student if the student participates in an alternative-to-expulsion program.  This student is being placed at the Sarasota County Technical Institute for GED preparation.



Recommendation

That Expulsion Case No. 10-201 be held in abeyance per School Board Policy 5.34.

18. APPROVAL TO AWARD BID # 0533 FOR MIDDLE SCHOOL PHYSICAL EDUCATION UNIFORMS
Description
Bids to provide 'Middle School Physical Education Uniforms' were received from eleven vendors on January 26, 2010. The bids of American Apparel Designs, Ball & Shoe Sports Center, Gulf Breeze Apparel and Royal-Tee's, Inc., were the best low bids meeting the advertised specifications. Reasons for not selecting the apparent low bid are included with the bid tabulation. This bid is for a period of one year with the option to renew for two additional one-year periods. The funds for these purchases are contained in the internal accounts of the middle schools.

Recommendation
That the bids of American Apparel Designs, Ball & Shoe Sports Center, Gulf Breeze Apparel and Royal-Tee's, Inc., to provide 'Middle School Physical Education Uniforms' in an amount not to exceed $60,000.00, be approved for award and purchase.

Description
Bids to provide 'Books and Educational Materials' were received from 23 vendors on January 28, 2010. The bids of Baker & Taylor, Inc., Barnes & Noble, Borders Books and Music, Budgetext, Complete Book and Media Supply, Davidson Titles, Inc., Delaney Educational Enterprises, Inc., Follett Educational Services, Inc., Follett Library Resources, Inc., and The Book Company were the best low bids meeting the advertised specifications based on a sample list. This bid is for a period of one year with the option to renew for two additional one-year periods. The funds for these purchases are contained in the operating and internal accounts of the schools and departments.

Recommendation
That the bids of Baker & Taylor, Inc., Barnes & Noble, Borders Books and Music, Budgetext, Complete Book and Media Supply, Davidson Titles, Inc., Delaney Educational Enterprises, Inc., Follett Educational Services, Inc., Follett Library Resources, Inc., and The Book Company, to provide 'Books and Educational Materials' in an amount not to exceed $250,000.00, be approved for award and purchase.

20. APPROVAL TO AWARD BID #0532 FOR TWO-WAY RADIOS AND DEVICES - SUPPLY AND REPAIR
Description
Bids to provide 'Two-Way Radios and Devices - Supply and Repair' were received from six vendors on February 9, 2010. The bid of Wireless Technology Equipment Company, Inc., was the best low bid meeting the advertised specifications. Reasons for not selecting the apparent low bids are included with the bid tabulation. This bid is for a period of one year with the option to renew for two additional one-year periods. The funds for these purchases are contained in the capital and operating budgets of the School Police/Safety and Security Department.

Recommendation
That the bid of Wireless Technology Equipment Company, Inc., to provide 'Two-Way Radios and Devices - Supply and Repair' in an amount not to exceed $150,000.00, be approved for award and purchase.

CONSTRUCTION

21. APPROVAL OF AMENDMENT #1 TO ARCHITECT'S AGREEMENT FOR THE VENICE HIGH SCHOOL RE-BUILD PROJECT
Description
The original Agreement Between Owner and Architect for Design and Construction Administration Services was for the Schematic Phase only. The scope of work for this amendment is to add the Design Development, Construction Documents and Construction phases of the project.  Amendment #1 shall also include the changes identified on the attached "Agreement Between Owner and Architect" document. The total amount for these changes shall not exceed $4,270,000.00. The funds for this amendment are available through the project budget.

Recommendation
That Amendment #1 to the Agreement dated 7/21/2009 with Schenkel Shultz, Inc. for the Venice High School Re-build project be approved as presented.

22. ACCEPTANCE OF CONSTRUCTION SERVICES' PROJECT(S) COMPLETION AND APPROVAL OF FINAL PAYMENT TO CONTRACTOR(S)
Description
The substantial completion dates, original and final contact amounts are summarized on the enclosure for ease of review. All work has been completed and all required close-out documents have been received from the contractor(s). The Executive Director of Construction Services has determined that the projects are complete in accordance with state statutes. The seven (7) projects were completed for a net combined savings of $52,334.44 below the contract amounts.

Recommendation
That the cited Construction Services' projects be accepted as complete and the final payment to contractors be approved as presented.
